The original contractor for this signal has gone out of business. Our attorney is working on reaching an agreement with the bonding company who represents the original contractor. Once an agreement is reached, a new contractor will be moved in and the signal construction will resume.

Is there a time frame on this? This intersection is becoming very dangerous in the afternoons.

A new schedule has not yet been developed since the agreement with the bonding company has not yet been finalized. I will post new information as soon as it is available.

Update 12/15:

The city has been obligated to work through the bonding company and has been diligent in that effort. Agreements for the takeover of construction of traffic signals at Parkwood/Lebanon and Coit/FM 3537 are expected to be on the Tuesday, 12/21 City Council agenda for approval. Upon approval I will post schedule information as described in those agreements.

We are currently working with the new contractor. You will begin to see more activity over the next couple of weeks. The signal should be complete by late February.

Is there any update for the Lebanon/Parkwood signal? Traffic through that intersection is getting worse by the day and backing up farther and farther.

According to Brian Moen, Transportation Manager, he continues to press the bonding company and their new contractor to complete this work. They will not meet the completion time referenced in the post of 1/21. They have committed to delivering a revised schedule for staff review on Friday of this week.

GHM,

Unfortunately, I don't think you can totally prevent this from occurring. Through the City’s bidding and contracting process, the contractor is required to have various types of bonds and insurance. These bonds are required for both construction performance and maintenance performance after the project is completed. In this case, the performance bond had to be used because the contractor went out of business. This is extremely rare for a contractor to go out of business in the middle of a construction job. This is the first time I am aware that it has happened in the City of Frisco on a roadway and/or traffic signal project.

I cannot predict if and when a particular company is going to go out of business while working on a project. If it is a contractor we do not deal with on a regular basis, we call other cities where the low bid contractor has done work before the bid is awarded to see if they are getting the projects complete and doing quality work. If those answers are positive and the city does not have another defensible reason to disqualify a contractor, then you essentially have to accept the low bidder in accordance with state law.

All of these proactive steps were done to try and ensure the traffic signal project contractor would be able to adequately perform the construction project in question. We are working with both our attorneys, purchasing department and contract administrator to see if other steps can be implemented to avoid this from occurring in the future, but there will never be a total guarantee that this does not happen. Unfortunately, we have had little success with the Surety Company completing the work even though there was a performance bond for this project. We are working to try and resolve these legal issues as quickly as possible to complete this project. We understand the need to finish this project and have the traffic signal operational as soon as possible.
