The Building Inspection FAQ says that fences can be 8 feet from grade. Then, in the Pool and Spa fence requirements, the limit is 8 feet, without regard to the grade. Why the discrepancy, and is this actually enforced?

There is no discrepancy. Pool fences are measured from yard grade. Yard grade makes no provision for built-up decks, etc. If a yard has a built-up deck, the measurement would still be taken from the actual grade of the yard. Fences can set on retaining walls, this will give a higher measurement on the outside, but the actual yard grade would be used to determine the fence height.

The pool guidelines say that a "Barrier" can't be taller than 96" (8 feet). If a retaining wall or fence is built from grade, why isn't it included in the "barrier" measurement?

Fences are measured from grade inside the yard. Some yards are enclosed by a retaining wall. The measurement from grade outside the yard could be more than 8 feet, while the measurement from grade inside the yard would be 8 feet or less.
