Our HOA has just proposed an ammendment that would forbid all residents from parking on public streets. This would include parking your own car in front of your own house.

Since these are public streets managed by the city, wouldn't this be beyond the scope of power of an HOA?

It is our understanding that the Supreme Court ruled that HOA's cannot regulate on-street parking on public streets.

Do you have a link or can you post the ruling here? Is this the US Supreme Court or Texas Supreme Court?

I have received conflicting information on this topic. I spoke with the City Attorney last night and was advised that it is a civil matter and would most likely require a lawsuit to determine. Both sides seem to have merit, however a court must decide the issue.

From the city's perspective, the regulations of the HOA are not enforceable by the police department.
