Is it illegal to cross lanes and enter the median when traffic is clear on one side and sit there and wait for traffic to clear on the other side before merging with traffic or turning left?

I see this every day on streets like Preston. The problem this creates is that it blocks oncoming traffic that have the right-of-way from completing a left turn or the rear end of their vehicle blocks the left most lane of the side they crossed.

It is violation of the Texas Transportation Code to block an intersection, such as you described. If a vehicle is pulling out from a private drive, parking lot, or separate roadway, they cannot stop in the intersection and wait for traffic to clear. Doing so is in violation of Section 545.302 of the Traffic Code. There are other violations in the Traffic Code that may also apply, depending on factors associated with the violation.

Unfortunately, this type of incident occurs all the time and does cause visibility problems for all vehicles involved. We have responded to motor vehicle collisions that are a result of this type of driving and do issue citations for violations that we observe. As always, our Traffic Unit and patrol officers work to educate the public on all traffic laws and both warn and cite violators of this and other traffic-related violations.
