Recently, I found the combust air pipe from my fireplace goes to the roof though the attic. My question is how the cold air comes in because in this situation, it seems that only hot air inside the fireplace can rise out through the pipe. Is there any code violation here?

The pipe you describe appears to be a flue pipe for your fireplace, not a combustion air supply pipe.We would need more information, before determining if there is a code violation. Please call this department at 972-335-5580 ext. 105 or 106. Ask to speak to a Mechanical Inspector. He will help you make the determination.
