My wife and I have lived in Frisco for almost 2 years now, and we are noticing more and more of a loitering problem in the downtown Frisco area. It is now a major issue with most residence I talk to. What is Frisco's loitering laws, and why are they not being enforced? If there are no laws pertaining to loitering, what are the proper steps to get something put in place?

Frisco does not have a loitering ordinance. They were found to be unconstitutional by the US Supreme Court. The establishment(s) where individuals are hanging out are not public but private property. The property owners determine if they want them there or not. A property owner may request to give an individual a criminal trespass warning. If the individual refuses to leave after notice is given, then he or she has committed a criminal offense. If a criminial offense is occurring, the police department will respond, investigate, and take appropriate action.

Thanks for the quick responce! Its nice to know we live in a city where the public officals and employees of the city actually take time to answer questions from the residence. It truely is refreshing!
