There is a golf club driving range along Lebanon, east of Hillcrest, that does not have protective nets installed.

Should a passing vehicle get struck by a flying golf ball, who is responsible for the damage?

Follow up question, is the city responsible for creating a safe environment and force the driving range to put up a net around their complex? I see people walking their dogs on Lebanon and fear that they will get hit by a ball.

From a criminal standpoint there is would be no offense unless patrons of the driving range were intentionally hitting toward the street in an attempt to hit vehicles. Otherwise it would be a civil issue between the subject that struck the passing car, the victim, and maybe the driving range. There is a reckless damage statute that is a class C misdemeanor but I donít think it applies here because the patrons are hitting golf balls at a driving range which is not gross deviation from the standard of care that a normal person would exercise. This would probably apply if a person was hitting golf balls in area not designated this type of activity and then strikes a car (ex hitting golf balls from a park, median, side of the road, etc.)

The City does not have the authority to require the golf course to install nets.

Preston street lighting?

I see that crews are constructing light poles along Preston Rd. (North of Main St. to US 380). When is the project expected to be completed and the lighting be turned on?

The contractor plans to have all of the new light poles on Preston Rd installed and operational by the end of May. However, this could be delayed until early June depending on when the electric company installs the meters in the new lighting services.
