I would like to know if the city has considered taking any action or enacting any city policy regarding the construction of homes and timeframes? The unfinished home on the corner of Rogers and Fisher has become an eyesore and represents a danger to the children who cross into the construction area - signs or no signs. This home has been under construction for over 3+ years correct? Why has nothing been done to force the owner to finish or sell or possibly levy fines against the owner?

The City does have an ordinance to provide regulations for the repair or removal of substandard or uninhabitable structures for public health or safety reasons, but not aesthetics. The process for declaring a structure as uninhabitable is long and potentially expensive and has not been pursued at this point due to staff’s interaction with the owner and his architect regarding resumption of construction on the residence. The owner has been responsive to City staff when contacted about correcting health and safety concerns. We are currently reviewing the substandard structure ordinance in consideration of initiating proceedings for this property.

So it's been more than a year now since this last update without ANY progress on this property, apart from leaning old plywood panels up against some of the front windows. Are there any teeth whatsoever in any city ordinance that would get these owners to demonstrate some measure of responsibility for their property and their neighbors? It is a nuisance in the neighborhood and as Robert says above it is a potential hazard for children coming and going from Rogers Elementary. FC Dallas Stadium, Dr Pepper Ballpark, American Airlines Center, Rangers Ballpark in Arlington and even Dallas Cowboys Stadium were each finished in less time.

All we can do is make sure all nuisances and hazards are abated. The property owner has been responsive to our requests to abate nuisances and secure the property. Proving that the structure is substandard and an imminent hazard to life safety is a long process and has been made more difficult based on recent court rulings. The property owner told me last week that he anticipates beginning insurance repairs on the issues that have been the center of the legal matters regarding the property within the next two weeks.
